Tack: Terms and Conditions

Welcome to Tack! By accessing or using our web application ("Service"), you agree to comply with and be bound by the following terms and conditions ("Terms"). Please review them carefully. If you do not agree to these Terms, you should not use our Service.
1. Acceptance of Terms
By using Tack, you agree to these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent that you have the authority to bind the organization to these Terms.
2. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the Service after any changes indicates your acceptance of the new Terms.
3. Eligibility
You must be at least 13 years old to use the Service. By using the Service, you represent and warrant that you meet this requirement.
4. Account Registration
To use certain features of the Service, you may need to create an account. You agree to provide accurate and complete information when creating your account and to update your information as necessary. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.
5. User Conduct
You agree not to use the Service to:
Post or share any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
Impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity.
Violate any applicable laws or regulations.
Interfere with or disrupt the Service or servers or networks connected to the Service.
6. Content
Admin Posts: Posts made by group admins are public and can be accessed by anyone.
Member Posts: Posts made by group members are accessible only to group members and will disappear after 14 days.
You retain ownership of any content you post on the Service. However, by posting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute your content for the purpose of operating and providing the Service.
7. Privacy
Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your information. By using the Service, you consent to our collection and use of your information as outlined in the Privacy Policy.
8. Termination
We may terminate or suspend your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease.
9. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted or error-free.
10. Limitation of Liability
In no event will Tack, its affiliates, or their respective officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service.
11. Governing Law
These Terms will be governed by and construed in accordance with the laws of Kenya, without regard to its conflict of laws principles.

Tack Privacy Policy

Tack ("we," "our," or "us") is committed to protecting your privacy. This Privacy Policy explains how we collect, use, and disclose information about you when you use our web application ("Service").
1. Information We Collect
Account Information: When you create an account, we collect your first and last name, username, email address, phone number and other information you will provide later when accessing other financial/payment services.
Content: We collect any content you post on the Service, including admin posts and member posts.
Usage Data: We collect information about your use of the Service, such as your IP address, browser type, and pages visited.
2. How We Use Information
We use the information we collect to:
Provide, maintain, and improve the Service.
Communicate with you about your account and the Service.
Monitor and analyze usage and trends to improve the Service.
Protect the safety and security of our users and the Service.
3. Sharing of Information
We do not share your personal information with third parties except in the following circumstances, with your consent through a prior statement or email:
1. With service providers who perform service to you after joining their Tack: example an online meeting event organisers that wants to send meeting link via attendants' email.
2. Legal authorities if required by law and through the proper procedures.
4. Data Retention
We retain your information for as long as necessary to provide the Service and fulfill the purposes described in this Privacy Policy.
Content posted by members will automatically be deleted after 14 days of being posted, or the last reply on the same.
5. Security
We take appropriate measures to protect your personal information from unauthorized access. By using our service, you are also commiting to take appropriate measures to protect your personal information, such as using strong passwords and logging out of your account in cases where YOU HAD TO use a shared device.
Changing your password requires a reset code sent to your email, and changing your pin requires an active access to your Mpesa Line. When these are passed you give us permission to change your mentioned credential.
Changing your password requires you to log in again across all devices you had active sessions on.
6. Your Rights
You have the right to access, correct, or delete your personal information. You may also have the right to object to or restrict certain processing of your information. To exercise these rights, please contact us at accounts@tack.plus.
You may also opt-out of certain communications or notifications from us using appropriate account settings or by following the opt-out instructions provided in those communications.
7. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. If we make changes, we will notify you by revising the effective date at the top of the policy. Your continued use of the Service after the changes take effect indicates your acceptance of the revised policy.
Terms of Service for Tack Group Raising Features
a. Creating and Managing Groups
Users can create or use Tacks for collective payments. The creator of a Tack may set the agreed-upon amount per
person and define the purpose of the collection.
a. Transaction Fees
Mpesa charges transaction fees for these services. These fees will be clearly communicated to
users before completing the transaction.
User Responsibilities
a. Accurate Information
Users must provide accurate and up-to-date information during the registration process and while using Payment service.
b. Tacktag squatting and impersonation
"Tacktag squatting and impersonation" on this platform would mean registering or using popular brand's terms, words or portions of their identities
to identify yourself. This can be done to exploit the popularity of a particular Tacktag for personal
or commercial gain. Tacktag squatting and impersonation is unethical and purnishable on our platform according to these terms,
especially when it obstructs genuine discourse or engagement on social media platforms. You cannot tag your activity page with obvious
brand words like WorldVision, for example, unless you can prove to be World Vision organisation as registered in Kenya. Newly created
tacks are monitored and can be flagged and further action be taken on the creator. Avoid malicious behaviour that can result in action in the court of law.
b. Security
Users are responsible for maintaining the security of their account credentials and must notify Tack
of any unauthorized access or use.
Termination of Service
Tack reserves the right to terminate or suspend service to any user at its discretion, with or without
cause.
